PAYMENT

A minimum 50% deposit is required to commence the design process, secure gemstones and materials, and begin the manufacturing process. This deposit is non-refundable once work has commenced.

Production will only commence once the customer has approved the final design. Any changes requested after approval may incur additional costs and may extend the estimated completion timeframe.

Upon completion, Misko will provide photographs and/or videos of the finished piece. The remaining balance is payable within 48 hours of notification of completion and must be received prior to collection or dispatch.

Misko accepts payment via direct bank transfer and credit card. Applicable credit card surcharges will be applied at the time of payment.

Quotations are valid for seven (7) days unless otherwise specified.

MANUFACTURING TIMEFRAMES

Estimated completion dates are provided as a guide only. While every effort is made to complete orders within the estimated timeframe, delays may occasionally occur due to gemstone sourcing, supplier availability, manufacturing requirements or circumstances beyond our control.

SHIPPING

Domestic orders are shipped via Australia Post Express with tracking and signature on delivery. TNT may be used for domestic orders over AUD $10,000 or where expedited delivery is requested, at an additional cost.

International orders over AUD $10,000 are shipped via FedEx, with shipping costs quoted upon request.

All shipments are insured for the full purchase price through our third-party insurer, provided the shipping details supplied by the customer are complete and accurate.

DUTIES & TAXES

For international orders, import duties, customs charges, VAT/GST and local taxes may be payable depending on the destination country’s regulations.

These charges are the responsibility of the recipient and must be paid before the parcel can be released by customs authorities.

NATURAL GEMSTONES

Natural gemstones are unique products of nature. Variations in colour, tone, inclusions, pattern and appearance are natural characteristics and are not considered faults.

CUSTOMER-SUPPLIED GEMSTONES

Misko takes every reasonable precaution when handling customer-supplied gemstones.

However, gemstones may contain existing inclusions, fractures or structural weaknesses that are not visible prior to setting, unsetting or manufacturing. Accordingly, Misko accepts no liability for damage that may occur during these processes.

All customer-supplied gemstones must be accompanied by the customer’s estimated replacement value in Australian dollars at the time they are entrusted to Misko.

CUSTOMER PROPERTY & INSURANCE

Customer property entrusted to Misko for repair, remodelling or manufacture is handled with the utmost care.

While we maintain insurance for stock on entrustment and goods being worked upon, all claims are subject to the terms, conditions, exclusions, excesses and coverage limits of our insurer.

Where an insured loss is accepted by our insurer, any settlement will be administered in accordance with the insurer’s policy.

Customers are encouraged to maintain their own insurance for particularly valuable or sentimental items.

UNSETTING STONES

A nominal fee applies for unsetting gemstones from existing jewellery due to the specialised skill, labour and time involved.

FAULTS & WARRANTY

Every Misko Jewellery piece is individually handcrafted. As such, slight variations between pieces are a natural characteristic of handmade jewellery and are not considered faults.

Our jewellery is designed to be worn and enjoyed; however, fine jewellery should always be treated with care. Normal wear and tear, accidental damage, misuse, impact damage, loss of stones caused by external force, or damage resulting from improper care are not considered manufacturing faults.

If you believe your jewellery has a manufacturing fault, please contact our studio at info@misko.co. Each piece will be assessed in accordance with our warranty policy.

REPAIRS & RESIZING

Should your jewellery require repair, resizing or maintenance, please contact our studio. Every repair is assessed individually, and recommendations and pricing will vary depending on the nature of the work required.

STORAGE OF COMPLETED ORDERS

Completed orders should be collected or shipped promptly following notification of completion.

Items remaining uncollected for more than 30 days may incur reasonable storage fees. Misko reserves the right to retain possession of the item until all outstanding amounts, including any applicable storage charges, have been paid.

LIMITATION OF LIABILITY

Nothing contained within these Terms & Conditions excludes, restricts or modifies any rights or remedies available to consumers under the Australian Consumer Law.

To the maximum extent permitted by law, Misko’s liability is limited to repairing, replacing or refunding goods or services where required under the Australian Consumer Law.

INTELLECTUAL PROPERTY

All original Misko Jewellery designs, concepts, drawings, CAD files, photographs, imagery and other intellectual property remain the property of Misko Jewellery and are protected under the Copyright Act 1968 (Cth).

No design, image, concept or artwork may be reproduced, copied, manufactured or distributed without the prior written consent of Misko Jewellery.
